1. Introduction & Acceptance of Terms

Welcome to FactoryType Studio (factory738.com). These Terms and Conditions govern your relationship with our independent digital type foundry based in Bali, Indonesia. By accessing our website, creating an account, or downloading any free or paid font products, you fully accept and agree to comply with these terms, our Privacy Policy, and our specific End-User License Agreements (EULA).

If you represent an agency or a corporation, you warrant that you have the legal authority to bind your entity to these terms. If any part of these terms does not align with your internal compliance, please contact our administrative desk at hello@factory738.com before making any transaction.

2. Account Registration & Security

To purchase our work or access specific downloads, you may be required to register an account.

• Accuracy: You must provide accurate, complete, and updated information during registration.
• Security: You are solely responsible for safeguarding the credentials of your account. Any activity performed under your username is deemed your legal responsibility.
• Notification: If you suspect an unauthorized breach or security compromise of your account, you must notify us immediately at hello@factory738.com. We reserve the right to suspend accounts that provide fraudulent data.

3. The FactoryType Licensing & Product Ecosystem (Strict Bundle Model)

At FactoryType Studio, we purposefully build our typefaces to function as unified typographic systems. Therefore, our commercial products are exclusively sold in Complete Family Bundles (e.g., Studio Bundle or Corporate Bundle). We do not distribute single weights or individual font styles.

By purchasing or downloading our fonts, you agree to the following structural terms:

• The EULA Framework: All font files are accompanied by a specific license tier (Freebies, Studio, or Corporate). The scope of what you can and cannot do with the font software is strictly bounded by the Font License Comparison Table and the specific EULA matching your receipt.
• Modification: Unauthorized reverse-engineering, converting, renaming, or modifying the internal font code of our software is strictly prohibited, unless explicitly granted under a verified Corporate Bundle agreement for custom logotype optimization.

4. Financial Transactions, Pricing, & Fraud Prevention

• Billing Information: When purchasing a Bundle, you must provide valid billing and payment data. All automated payments are securely processed via verified third-party gateways (Stripe/PayPal).
• Direct Invoicing: For enterprise procurement and corporate wire transfers, formal corporate invoices can be generated manually by contacting our finance desk.
• Order Cancellation: We reserve the right to refuse or cancel any order at our sole discretion if we suspect fraudulent activity, unauthorized transactions, or clear typographical errors in pricing and availability. If an order is canceled after payment, a full refund will be issued immediately.

5. Digital Product Delivery & Refund Policy

• Instant Delivery: Upon successful checkout, font software components (.OTF, .TTF, .WOFF, .WOFF2) will be delivered instantly to your registered dashboard or email.
• Refund Eligibility: Due to the non-returnable nature of digital font software, all sales are final. However, we offer a dedicated 30-day technical warranty. If a font file exhibits a proven technical flaw or software bug that our studio cannot resolve within 14 business days of being notified, a full refund will be issued.

6. Intellectual Property Rights & Lifetime Updates

• Ownership: All fonts, software code, graphic designs, specimen visuals, and text on this website are the lifelong creative work and exclusive intellectual property of FactoryType Studio. They are protected under Indonesian Copyright Law, International Treaties, and global Trademark frameworks. Purchasing a font bundle grants you a non-exclusive, perpetual license to use the software—it does not transfer copyright ownership.
• Lifetime Updates: Studio and Corporate Bundle purchases grant you free access to lifetime updates of that specific family. If we expand the family bundle with additional weights, ligatures, or language tracking, updates will be accessible via your user dashboard without any recurring fees.

7. Permitted User Conduct & Restrictions

To keep our creative space safe, you strictly agree not to:

• Redistribute, rent, lease, sub-license, or resell our raw font software files to third-party marketplaces, clients, or peer networks.
• Use our digital services or font files in any defamatory, illegal, hate-speech, or unauthorized commercial distribution context.
• Attempt to breach, scrape, or disrupt our website infrastructure using automated bots, viruses, or malicious software scripts.

8. Communication & Studio Updates

When you establish an account or secure a license, you are opted into our studio newsletter to receive critical software updates and new release announcements. We value your inbox space and guarantee zero spam. You can opt-out at any time by clicking the “unsubscribe” trigger at the footer of our emails or contacting our team.

9. Limitation of Liability & “As-Is” Warranty

• As-Is Basis: While we continuously stress-test our typefaces across major operating systems and UI/UX design software (Figma, Adobe Creative Suite, Canva), our services and software are provided on an “as-is” and “as-available” basis.
• Liability Cap: To the maximum extent permitted by applicable global law, FactoryType Studio shall not be liable for any indirect, incidental, or consequential damages (including loss of business profits or data) arising from the installation or usage of our software. In any dispute, our total maximum liability is strictly capped at the exact amount paid for the product on your official receipt.

10. Indemnification

You agree to indemnify, defend, and hold harmless FactoryType Studio, its founders, and designers from any claims, losses, liabilities, or expenses (including legal fees) arising from your misuse of our font software or violation of the specific EULA terms assigned to your purchased bundle.

11. Governing Law & Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Indonesia. We highly value mutual respect, empathy, and professional integrity. In the rare event of a legal or operational conflict, both parties agree to first seek an amicable, direct, and peaceful resolution via mediation before escalating to local arbitration courts in Bali, Indonesia.

12. Amendments to Terms

As FactoryType Studio expands its international catalog, we may occasionally update these terms to reflect new compliance requirements. All revisions will be posted transparently on this page with an updated “Last modified” date. Continued usage of our website or licensed assets post-update constitutes your agreement to the revised terms.
